Canada is said to have vowed to take matters regarding Korea's suspension of Canadian beef imports to a higher level.
Canada says it is set to ask the World Trade Organization to set up a dispute settlement panel against Korea saying that Korea's Act on the Prevention of Livestock Epidemics violates WTO regulations.
The law was revised in September 2008 after a series of mad cow disease outbreaks in the United States.
Under the revised law‚ beef that is older than 30 months cannot be imported from countries with a history of bovine spongiform encephalopathy‚ or BSE outbreaks‚ within the past five years.
Korea has banned imports of Canadian beef since 2003 after they were found to be contaminated with BSE.
But in May 2007‚ Canada was given "controlled-risk" status for BSE by the World Organization for Animal Health.
The two sides conducted a number of negotiations‚ but in November last year‚ Korea found Canada's 15th case of BSE and continued to maintain its stance.
So in April‚ Canada filed a Request for Consultations with Korea at the WTO.
But the two sides failed to reach an agreement even after 60 days‚ and this time‚ Canada is ready to request a dispute settlement panel.
The Korean government can reject the proposal once‚ which it says it will do‚ to prove that the law is in compliance with WTO regulations.
But Canada will still have another chance to submit a request‚ which Korea will not have a choice but to follow.
The panel will be formed by member countries of the WTO and a third country will be allowed to take part in the dispute settlement procedure as well.
If Korea and Canada come up with a solution‚ the process can be ended regardless of the third participant at any time.
