Korea's first lawsuit filed against a tobacco company by 31 lung cancer patients which has dragged on for 12 years was rejected by the Seoul High Court on Tuesday.
Back in 1999‚ a group of lung cancer sufferers and their families sued the country's biggest tobacco company‚ KT&G‚ arguing long-time smoking had caused their cancer and that KT&G had failed to inform them of the dangers of smoking by hiding its manufacturing records.
Then in 2007‚ the Seoul Central District Court rejected the plaintiffs' claim citing insufficient evidence to prove the company had flawed products and that there is no direct link between their illnesses and smoking.
The court added that KT&G has attached a warning message on its cigarette packs since the 1970s therefore hadn't violated its obligations.
Four years have passed since then and on February 15th‚ 2011 the Seoul High Court turned down appeals filed by the patients saying there is "no evidence" to prove that KT&G did anything illegal to cause lung cancer.
The court‚ however‚ did say that there is a connection between smoking and lung cancer and that tobacco companies should put more efforts into anti-smoking campaigns.
Disappointed by the latest decision the attorney for the plaintiffs said they would now bring the case to the Supreme Court.
KT&G‚ on the other hand welcomed the news adding that the plaintiffs should "stop their meaningless litigation."
More than 50-thousand people die from smoking each year in Korea and the government has been trying to reduce the smoking rate by restricting people from lighting up in public places.
